Please read Section 12 carefully. It requires you and EZ Insurance to resolve most disputes through individual binding arbitration rather than in court, and it waives class actions and jury trials. You can opt out of arbitration within 30 days, as explained there.
1. Agreement to these terms
These Terms & Conditions (“Terms”) are an agreement between you and EZ Insurance Services Inc (“EZ Insurance,” “we,” “us”). They apply when you use our website, request a quote, or receive messages from us. By using our website or services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website. You must be at least 18 years old to request a quote.
2. Who we are and how we’re paid
EZ Insurance Services Inc is a licensed independent insurance agency (CA License #0E86532), licensed in 48 states and Washington, D.C. We are an insurance producer: we help you compare and buy coverage from insurance companies, but we are not an insurance company and we do not issue policies or pay claims.
Compensation disclosure. We are usually paid a commission by the insurance company that issues your policy. The amount may vary depending on the insurer, the type of policy, the premium, and whether the policy is new or a renewal. You do not pay us a separate fee for a quote. You may request more information about the compensation we expect to receive for your policy by contacting us.
3. Quotes and coverage
- Quotes are estimates, not offers. A quote is based on the information you provide and is not an offer or contract of insurance. Final price and eligibility are set by the insurance company after underwriting and may differ from the quote.
- No coverage until confirmed. Submitting a quote request does not bind or start coverage. Coverage begins only when an insurance company approves your application, you accept the terms, any required payment is made, and you receive written confirmation of coverage. Do not cancel existing coverage until new coverage is confirmed.
- No guarantee. We cannot guarantee that any insurer will offer you coverage or a particular price.
- Your policy controls. Coverage is governed only by the terms, conditions, and exclusions of the policy issued by the insurer. Descriptions of coverage on our website are general and do not change any policy.
- Accurate information. You agree to provide true, accurate, and complete information, and to provide information only about yourself or people who have authorized you to share it. Inaccurate or incomplete information can change your price, lead to a denied claim, or cause a policy to be cancelled or rescinded.
- Not legal or tax advice. Our agents can explain insurance options, but nothing we provide is legal, tax, or financial advice.
4. Messaging Terms & Conditions
Program. EZ Insurance Services Inc (EZ Insurance) sends text messages to customers who opt in, for example by checking the text message consent box on our quote form.
Types of messages. You agree to receive informational and customer care messages from EZ Insurance Services Inc, including updates about your quote, follow-ups from your agent, appointment reminders, and policy servicing messages. Messages may be sent using automated technology.
Message frequency varies. Message and data rates may apply.
Help. For help, reply HELP or email us at info@ezinsurance123.com. You can also call (800) 895-7033.
Opt out. You can opt out at any time by replying STOP. You will receive one message confirming your opt-out, and no further messages will be sent unless you opt in again.
Consent is not a condition of purchase. You do not need to agree to text messages to get a quote or buy a policy.
Wireless carriers are not liable for delayed or undelivered messages. If you change or give up the mobile number you provided, please let us know so we stop texting it. Your information is handled as described in our Privacy Policy.
5. Calls, email, and electronic records
By submitting a quote request, you agree that a licensed agent may contact you by phone or email at the number and address you provide about that request. Calls may be recorded for quality and training. You can ask us to stop calling or emailing at any time.
You agree that we may provide notices, disclosures, and other communications to you electronically, by email or by posting them on our website, and that electronic communications satisfy any legal requirement that they be in writing. Insurance companies may ask for separate consent to deliver policy documents electronically.
6. Using our website
You agree not to:
- Submit false information or impersonate anyone.
- Submit someone else’s information without their permission.
- Use bots, scrapers, or other automated means to access or collect data from the website.
- Interfere with, disrupt, or try to gain unauthorized access to the website or its systems.
- Use the website for any unlawful purpose.
We may suspend or end access to the website for anyone who violates these Terms.
7. Our content
The website and its content, including text, illustrations, logos, and the EZ Insurance name and marks, are owned by or licensed to EZ Insurance and protected by intellectual property laws. You may use the website for your personal, non-commercial use. You may not copy, modify, or distribute our content without our written permission.
8. Third-party sites and services
Our website may link to or rely on services run by others, such as insurance company websites. We do not control and are not responsible for their content, products, or practices, and your use of them is governed by their terms.
9. Disclaimers
THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. This section does not limit any duty we owe you as a licensed insurance producer under applicable insurance law.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EZ INSURANCE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some states do not allow these limitations, so they may not apply to you. This section does not limit liability that cannot be limited by law, or any duty we owe you as a licensed insurance producer in placing or servicing your coverage.
11. Indemnification
You agree to indemnify and hold harmless EZ Insurance and its officers, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your submission of false information or information about others without their permission.
12. Dispute resolution and arbitration
Try to resolve it informally first
Most concerns can be resolved quickly by contacting us. Before starting arbitration or a lawsuit, you and we each agree to send the other a written notice describing the dispute and the relief requested, and to try in good faith to resolve it for at least 60 days. Send notices to us at info@ezinsurance123.com or to our mailing address in Section 16.
Binding individual arbitration
If we cannot resolve a dispute informally, you and EZ Insurance agree that any dispute, claim, or controversy arising out of or relating to these Terms, our website, our messages, or our services (a “Dispute”) will be resolved by binding individual arbitration, not in court. This includes Disputes about the interpretation, scope, or enforceability of this arbitration agreement. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, available at adr.org. The arbitrator may award the same individual relief a court could award. Arbitration will take place in the county where you live or another mutually agreed location, or by phone or video. Payment of filing and arbitrator fees will be governed by the AAA rules, and we will pay any fees the AAA rules require a business to pay.
Exceptions
- Either party may bring an individual claim in small claims court if it qualifies.
- Either party may seek relief in court for infringement or misuse of intellectual property.
- This agreement does not apply to claims under an insurance policy against the insurance company that issued it, which are governed by the policy and applicable law, or to complaints you file with a state department of insurance or other government agency.
Class action and jury trial waiver
YOU AND EZ INSURANCE AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND EZ INSURANCE EACH WAIVE THE RIGHT TO A JURY TRIAL. If this class action waiver is found unenforceable as to any claim, that claim will be decided in court, not arbitration, and the rest of this section will still apply.
Opting out
You may opt out of this arbitration agreement within 30 days after you first agree to these Terms by emailing info@ezinsurance123.com with your name, mailing address, and phone number and a statement that you opt out of arbitration. Opting out will not affect any other part of these Terms or your ability to get a quote.
Federal Arbitration Act
This arbitration agreement is governed by the Federal Arbitration Act. It survives the end of your relationship with us.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 12. For any Dispute not subject to arbitration, you and we agree to the jurisdiction of the state and federal courts located in Orange County, California, unless the law of your state requires otherwise.
14. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. Changes apply from the date they are posted, and your continued use of the website after that means you accept them. Changes to Section 12 will not apply to a Dispute that we already received notice of before the change.
15. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the website. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a sale or merger of our business.
